1. Acceptance of Terms
By accessing or using TheSoleRoom (the "Site"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.
2. Marketplace Nature & Independent Sellers
TheSoleRoom is a peer-to-peer marketplace platform. All products listed on the Site are offered for sale by independent third-party sellers ("Sellers"), not by TheSoleRoom itself. TheSoleRoom is not the seller of record for any transaction and does not take title to any item sold through the Site.
TheSoleRoom facilitates the connection between Buyers and Sellers and collects payment on behalf of Sellers. Each purchase constitutes a direct transaction between the Buyer and the applicable Seller. TheSoleRoom's role is limited to operating the marketplace infrastructure, enforcing platform policies, and providing dispute resolution support.
TheSoleRoom does not manufacture, inspect, or store any products listed on the Site. While we require Sellers to accurately describe their items and take action against policy violations (including our three-strike enforcement policy), we do not independently verify every listing.
3. As-Is Sales & Buyer Awareness
All footwear and goods sold through TheSoleRoom are sold "as-is." Because sales occur between independent parties, TheSoleRoom provides no warranties — express, implied, or statutory — regarding the condition, authenticity, fit, longevity, durability, or fitness for a particular purpose of any item purchased through the Site.
Normal wear-and-tear is not covered. Everyday footwear is subject to natural degradation over time including, but not limited to, sole separation, midsole compression, material cracking, color fading, and stitching wear. These characteristics are inherent to used and pre-owned footwear and do not constitute grounds for a refund, dispute, or warranty claim.
By completing a purchase you acknowledge that:
- You have reviewed the listing photos and description provided by the Seller.
- You understand the item is sold as-is by an independent Seller.
- TheSoleRoom's liability is limited to facilitating a fair dispute process where the Seller materially misrepresented the item (e.g., wrong size shipped, item condition significantly different from listing).
- Subjective dissatisfaction with condition, style, or fit does not entitle a Buyer to a refund or dispute resolution.
Buyers who receive an item that is materially different from its listing description may open a dispute within the 3-day dispute window following confirmed delivery. See our Shipping & Returns policy for details.
4. Products and Pricing
All products on the Site are subject to availability. Prices are set by individual Sellers and listed in US dollars. TheSoleRoom does not set or guarantee product pricing. We reserve the right to limit quantities and to refuse or cancel any order at our discretion.
Product images are provided by Sellers for illustration purposes. Actual colors and textures may vary slightly due to screen settings, lighting, or individual item variation.
5. Orders, Payment & Sales Tax
By placing an order you represent that all information provided is accurate and complete. Orders are not confirmed until payment is processed and you receive an order confirmation email.
We reserve the right to cancel orders in the event of pricing errors, stock unavailability, or suspected fraudulent activity. In such cases a full refund will be issued.
Sales Tax: Sales tax may be calculated and collected at checkout based on your delivery address and applicable state and local law. Where required by law, TheSoleRoom collects and remits sales tax on orders shipped to applicable states. The applicable tax amount, if any, will be displayed at checkout before you complete your purchase.
6. Shipping and Delivery
Items are shipped by individual Sellers. Delivery times are estimates and not guaranteed. TheSoleRoom is not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our control. Risk of loss passes to you upon delivery to the carrier.
7. Returns and Refunds
Our return and refund policy is described in our Shipping & Returns page, which is incorporated into these Terms by reference. Because all sales are peer-to-peer and as-is, returns are only accepted where the Seller materially misrepresented the item.
8. Brand Non-Affiliation Disclaimer
The brands, trademarks, and trade names referenced in listings on TheSoleRoom — including but not limited to Nike, Adidas, Jordan, New Balance, Yeezy, and similar — are the property of their respective owners. TheSoleRoom is not affiliated with, endorsed by, sponsored by, or officially connected to any such brand or trademark owner. The presence of a brand name in a listing does not imply any relationship between TheSoleRoom and that brand.
Where TheSoleRoom offers any listing review, verification badge, or similar feature, such services are provided solely by TheSoleRoom and are not affiliated with, certified by, or authorized by any brand whose goods may be referenced in a listing. Any "Seller-Verified" designation reflects only that the Seller has declared the item authentic — it does not constitute a guarantee, certification, or authentication by TheSoleRoom or any brand owner.
9. Platform Safe Harbor
DMCA Safe Harbor (17 U.S.C. § 512). TheSoleRoom is an online service provider and qualifies for safe harbor protection under the Digital Millennium Copyright Act. We do not create, upload, or control the content of individual Seller listings. When we receive a valid notice of copyright or trademark infringement, we act expeditiously to remove or disable access to the reported material. To submit a takedown notice, visit /dmca.
Third-Party Content (47 U.S.C. § 230). TheSoleRoom is an interactive computer service, not the publisher or speaker of any information provided by Sellers or other third parties. To the extent permitted by law, TheSoleRoom is not liable for any third-party content posted on the platform, including product descriptions, images, or claims made by Sellers in their listings.
Seller Data Disclosure. TheSoleRoom does not voluntarily share individual Seller account information, identity, or transaction data with brands, trademark holders, law enforcement, or any third party except where required by a valid court order, subpoena, or other binding legal process. Upon receipt of such compulsory legal process, TheSoleRoom will comply with its legal obligations and, where permitted by law, will endeavor to notify the affected Seller.
10. Site Intellectual Property
All content on this Site — including text, images, logos, and design — is the property of TheSoleRoom or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.
9. Disclaimer of Warranties
The Site and its content are provided "as is" without warranty of any kind, express or implied. TheSoleRoom does not warrant that the Site will be uninterrupted or error-free.
As described in Section 3, TheSoleRoom expressly disclaims all warranties relating to products sold through the marketplace, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. No warranty is made regarding the durability, longevity, or condition of any footwear sold by Sellers on this platform.
10. Limitation of Liability & Sole Remedy
To the fullest extent permitted by law, TheSoleRoom shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount paid for the order giving rise to the claim.
Sole Remedy for Canceled or Disputed Orders. In the event that TheSoleRoom cancels an order — for any reason including suspected fraud, policy violation, authenticity concern, or stock unavailability — the Buyer's sole and exclusive remedy is a refund of the purchase price and any shipping cost paid. TheSoleRoom shall not be liable for any additional damages, losses, or claims beyond that refund. This limitation applies whether the claim is based in contract, tort, statute, or any other legal theory.
No Consequential Damages. TheSoleRoom is not liable for lost profits, lost data, loss of goodwill, service interruption, or any special, incidental, indirect, or consequential damages arising out of or related to your use of the Site, even if TheSoleRoom has been advised of the possibility of such damages.
11. Dispute Resolution & Arbitration
Governing Law. These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law principles.
Informal Resolution First. Before filing any formal claim, you agree to contact us at legal@thesoleroom.com and give us 30 days to resolve the dispute informally. Most concerns can be resolved this way.
Binding Arbitration. If informal resolution fails, you and TheSoleRoom agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site through final and binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. The arbitration will be conducted in English, and the arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
CLASS ACTION WAIVER. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THESOLEROOM EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
Small Claims Exception. Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
Opt-Out. You may opt out of binding arbitration by sending written notice to legal@thesoleroom.com within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration.
Venue. For any claims not subject to arbitration, you consent to personal jurisdiction and venue in the state and federal courts located in Maryland.
12. Changes to Terms
We may revise these Terms at any time. Changes take effect when posted on this page. Continued use of the Site after any change constitutes acceptance of the new Terms.
