Terms of Service

The Sole Room (the "Site") is operated by HFS Commerce LLC, based in Potomac, MD.

By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site.

The Sole Room is a first-party online store. Products offered on the Site are listed and sold by The Sole Room; the Site is not a peer-to-peer marketplace and does not accept listings from independent third-party sellers.

We prohibit counterfeit, replica, unauthorized, stolen, and unlawfully obtained goods. We may review product records, remove products, cancel orders, or take other appropriate action when authenticity, ownership, or legal compliance is in question.

Each product is sold in the condition stated on its product page. New, new without box or tags, and pre-owned conditions are identified separately where applicable; do not assume an item is new or pre-owned if its condition is not provided. Contact us before purchasing if any condition detail is unclear. Product photos and descriptions form part of the item disclosure, and colors or textures may vary slightly due to lighting, screen settings, or individual item variation.

Normal wear and tear is not a product defect. Footwear may naturally experience sole separation, midsole compression, material cracking, color fading, and stitching wear over time. Any rights or remedies provided by applicable law remain unaffected.

Before purchasing, you should review the product photos, description, size, condition, and our Shipping & Returns policy. Subjective dissatisfaction with style, fit, or disclosed condition is handled only as provided in that policy and applicable law.

All products are subject to availability. Prices are set by The Sole Room and shown in U.S. dollars. We may change prices, limit quantities, correct errors, and refuse or cancel an order at our discretion, subject to applicable law.

By placing an order, you represent that the information you provide is accurate and complete. An order is not accepted until payment is processed and we send an order confirmation.

We may cancel an order because of a pricing error, stock unavailability, authenticity concern, policy violation, or suspected fraud. If we cancel after payment, we will refund the purchase price and any shipping charges paid.

Sales tax may be calculated and collected at checkout based on your delivery address and applicable law. Any tax due will be displayed before you complete your purchase.

The Sole Room fulfills orders from its own inventory. Delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, incorrect delivery information, or other circumstances beyond our reasonable control. Risk of loss passes as provided by applicable law.

Our Shipping & Returns policy is incorporated into these Terms by reference and explains return eligibility, deadlines, and refund processing. Nothing in these Terms limits rights that cannot legally be waived.

Brand names, trademarks, and trade names referenced on the Site belong to their respective owners. Unless a product page expressly says otherwise, The Sole Room is not affiliated with, endorsed by, sponsored by, or officially connected to those owners.

Any review or verification performed by The Sole Room is our own internal process and is not certification, authorization, or endorsement by a brand owner.

Site content, including our text, images, logos, and design, is owned by The Sole Room or used with permission and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from it without prior written consent or another lawful basis.

We respect third-party intellectual property rights. Rights holders may report content through our IP & Trademark Takedown page. We review notices promptly and may remove or disable reported content while we investigate.

To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available." We do not warrant uninterrupted or error-free access. Any product warranty is limited to an express warranty stated on the applicable product page; we are not the manufacturer and do not provide a manufacturer's warranty on behalf of any brand.

Some jurisdictions do not allow certain warranty exclusions, so these exclusions apply only to the extent permitted by law.

To the fullest extent permitted by law, The Sole Room will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or purchase of products. Our total liability for a claim will not exceed the amount paid for the order giving rise to that claim.

For an order we cancel, your sole remedy is a refund of the purchase price and shipping charges paid, except where applicable law requires another remedy. Limitations that are not enforceable in your jurisdiction do not apply to you.

Governing Law. These Terms are governed by Maryland law, without regard to its conflict-of-law rules.

Informal Resolution First. Before filing a formal claim, contact legal@thesoleroom.com and allow 30 days for an informal resolution.

Binding Individual Arbitration. If informal resolution fails, you and The Sole Room agree to resolve disputes arising from these Terms or the Site through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.

CLASS ACTION AND JURY-TRIAL WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE SOLE ROOM WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Either party may bring an eligible individual claim in small claims court. You may opt out of arbitration by emailing legal@thesoleroom.com within 30 days of first accepting these Terms, with your name, mailing address, and a clear opt-out statement. Claims not subject to arbitration must be brought in the state or federal courts located in Maryland.

We may revise these Terms by posting an updated version on this page. Continued use after the effective date constitutes acceptance of the revised Terms.
